Introduction to Export Control Classification

 

The US export control system follows a defined “order of review” between the International Traffic in Arms Regulations (ITAR) and Export Administration Regulations (EAR), which can be complicated. While government guidance is available to help navigate this process, newcomers to the system are often left wondering if they have followed the correct process and turned over every possible stone. An efficient and effective export classification process also requires ongoing partnerships between compliance and technical personnel.

This session is intended to orient those who are new to performing export controls classification, including compliance personnel, engineers, and product specialists, as well as for experienced practitioners who want to review the basics and ensure they are not taking any inappropriate “short cuts”.

Participants will learn how to follow the “order of review” between the ITAR and EAR, as well as to understand how US Munitions List and Commerce Controls Lists are structured, how to read an Export Control Classification Number (ECCN), and how to apply the “specially designed” definition. The session will also address procedures for filing a commodity jurisdiction request or commodity classification review with the relevant regulatory agencies, and how to cope with ongoing changes to the control lists, including the addition of new “emerging technology” ECCNs.

The session will be led by Jenna Glass, a Trade & Customs attorney from KPMG LLP, who also draws on her experience as an export compliance manager with a major semiconductor company.

Speaker: Jenna Glass, Attorney with KPMG, LLP

Jenna is a Senior Manager in KPMG’s Trade and Customs Practice, based in Chicago, IL.  She has over 13 years of experience in international trade compliance and supply chain operations.  For the past 8+ years, she has focused predominantly on export controls and sanctions.  She has substantial in-house experience at a renowned retail company as well as a notable U.S. technology company, where she managed a global team and was responsible for operational oversight in conjunction with developing export control-related strategies, and promulgating export control policies and procedures in the U.S., EU, and APAC.

Her most recent experience was serving as a Sr. Advisor at an international trade law firm, where she counseled clients exclusively on export controls and sanctions matters.
