Encryption Controls Webinar
The Encryption Export Controls virtual seminar is an in-depth session that will focus on the unique provisions related to encryption under the Export Administration Regulations (EAR), as well as providing an overview of foreign encryption export/import controls, as well as focusing on the practical aspects of implementing an internal compliance program and dealing with government regulators.
Our faculty will provide a comprehensive overview of:
- Identifying and classifying cryptographic items –controlled vs. decontrolled items
- License Exception ENC and mass-market provisions
- Special encryption classification, licensing and reporting procedures
- Foreign direct product rules
- Deemed exports
- Non-U.S. cryptography export and import control regimes, including France, Israel, China/Hong Kong, and others, and how to manage potential conflicts between US and foreign regimes
- Insights on how to collect necessary information and stay up-to-date with changes to cryptographic products
- Dealing with cryptographic items in the context of M&A and CFIUS
The program is designed to cover the fundamentals of U.S. encryption trade controls, as well as providing insights into the interaction with foreign controls, tough issues, and how to develop an effective compliance program for cryptographic items. Thus, the program will provide a firm grounding for those who are new to encryption controls, as well as a thorough refresher and “pro-tips” for experienced practitioners.
The program will allow for live Q&A, provide detailed electronic reference materials for ongoing use, and allow attendees the opportunity to view recordings of the sessions for one week following the seminar.
