Director of Import and Export Compliance

|
Fortinet, a dynamic and fast-paced newly-public Silicon Valley technology company with a global presence in the exciting and growing network security market, is looking for a take-charge Director of Import and Export Compliance with initiative and a good attitude, reporting directly to Fortinet’s Vice President, General Counsel.
Fortinet’s Director of Import and Export Compliance will be primarily responsible for oversight of export management systems (e.g., order processing, monitoring and screening, record keeping, auditing, and product and technology classification. This will include integrating proper processes and appropriate checks and balances to ensure compliance with export control laws applicable to shipments of high encryption products in a two-tiered distribution model. This person will interact regularly with the Finance and order management teams, the operations team, and the worldwide sales teams, Human Resources, Product Management and other functions to ensure trade compliance. Fortinet’s Director of Import and Export Compliance will also be responsible to engage in quarterly compliance and process training for all Fortinet sales teams.

Qualifications:
•At least 5 years relevant experience, including senior trade compliance roles at a publicly-traded company.
•Previous work with the export of high encryption (ENC-Restricted) products is required.
•Strong background working with Export Administration Regulations (“EAR”) encryption regulations, including classification, encryption review and exception requirements.
•In-depth working knowledge of EAR and U.S. Customs regulations and knowledge of related laws and regulations, such as the International Traffic in Arms Regulations, the Office of Foreign Assets Control sanction regulations, U.S. Customs' Border Protection and Foreign Corrupt Practices Act
•Experience and knowledge of licensing and all submissions to the U.S. Government including encryption and ELA post export reports.
•Experience with management of a global trade compliance program and cross functional teams;
•Demonstrated experience in the implementation of automated export screening software to various touch-points including the company’s ERP system.

Responsibilities:
•Drive coordination and communication across Fortinet functional groups to ensure better trade compliance risk identification and implementation of consistent compliance controls.
•Maintain or develop and implement export and import compliance policies, programs, processes, procedures, tools and templates, as appropriate in a rapid growth and changing environment.
•Review functional groups’ trade compliance effectiveness through oversight, continuous communication, training and audits. Manage those processes through a hub and spoke model, with direct responsibility for review of high risk orders, and export licensing.
•Responsible for commodity classification oversight in coordination with the new product team.
•Team with and manage one other employee dedicated to trade compliance.
•Manage and apply for Individual Validate Licenses (“IVLs”) and Encryption Licensing Arrangements (“ELAs”) and other license types where appropriate.
•Ensure proper processes around Fortinet’s Global Trade Management system, TradeBeam, and continue to integrate screening/licensing automation with other touch points as the company evolves their global logistics programs and modes of product delivery
•Coordinate with outside trade compliance attorneys as necessary and manage outside counsel to budget.
•Liaison with operations to assist with RoHS and environmental regulatory compliance and assist with compliance with Federal sales requirements and logistics matters.
•Perform continuous analysis of trade regulations to ensure timely provision of guidance to the businesses and implementation of procedural changes. Also provide expert guidance on regulatory matters relating to global trade compliance.
•Ensure proper import and customs processes.
•Report the trade compliance processes to the Audit Committee of the Board of Directors.
